CarEdit Terms of Service and User Agreement

Welcome to CarEdit! This agreement establishes the terms under which we provide our service to you. By using CarEdit, you agree to these terms. We've designed this agreement to be clear and fair, protecting both your rights and our ability to provide quality service.
1. Service Nature and User Rights
- CarEdit is provided as a service, not sold. You receive access to use the service according to your selected subscription plan.
- You maintain full ownership and rights to all results, outputs, files, and data created, processed, or generated using the CarEdit service.
- You are free to distribute, share, sell, or use any results, outputs, files, or data created through your use of CarEdit service for any lawful purpose.
- The service is designed to help you create valuable outputs, and we encourage you to share and distribute the results of your work.
- Your legal rights regarding the outputs you create are fully protected under applicable copyright and intellectual property laws.
2. Service Access and Account Protection
2.1. Individual Account Access
- Your CarEdit account and service access are personal and non-transferable. Access is granted under the model: 1 account = 1 user = 1 PC.
- The same restriction applies to unlimited plans: access is granted to one user only and for one personal computer only.
- You are responsible for maintaining the security and confidentiality of your account credentials.
- You may not share, transfer, rent, resell, or provide access to your account, login credentials, or service access to third parties.
- For the purposes of these Terms, third parties means any natural person or legal entity that did not participate in acquiring the license right of access and is not identified in the payment or registration records of the relevant license.
2.2. Permitted Sharing: Results vs. Access
Important Distinction:
- ✅ PERMITTED: Sharing, distributing, or selling the results, outputs, files, or data created using CarEdit service
- ❌ PROHIBITED: Sharing, transferring, or providing access to the CarEdit service itself, your account, or login credentials
In other words: you own what you create, but the service access remains yours alone.
- You are encouraged and permitted to share, distribute, publish, sell, or otherwise use any outputs, results, or files created through your use of CarEdit.
- This includes processed ECU files, modified data, reports, or any other results generated by the service.
- However, you may not share your account access, login credentials, or allow others to use the CarEdit service through your account.
3. User Responsibility and Service Limitations
3.1. Your Responsibility for Your Actions
- You are responsible for ensuring that your use of the CarEdit service complies with all applicable laws, regulations, and third-party rights in your jurisdiction.
- You are responsible for any actions you take using the service, including how you use the outputs and results you create.
- You understand that modifying vehicle ECUs or related systems may affect manufacturer warranties, and you assume responsibility for understanding and complying with manufacturer policies.
3.2. Service Provided "As Is"
- The CarEdit service is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to provide reliable service, we cannot guarantee error-free operation or uninterrupted availability.
- We do not warrant that the service will meet all your requirements or that results will be perfect for every use case.
- You use the service at your own discretion and risk. We recommend maintaining backups of your work and verifying results before using them in critical applications.
- To the maximum extent permitted by law, our liability is limited to the amount you paid for the service subscription.
3.3. Limited Purpose: Educational and Research Use
- The CarEdit service is primarily designed for educational, research, and learning purposes related to automotive electronics and ECU systems.
- You may use the service for legitimate educational, research, or learning activities.
- Any commercial or production use of the service is at your own risk and responsibility.
4. Payment and Subscription
- Access to service features is provided according to your selected subscription plan and payment.
- Service activation may require user authentication and verification.
- Refunds are handled according to our refund policy. Please contact support for refund inquiries.
- Subscription fees are for service access, not for purchase of software or ownership rights.
5. Service Updates and Changes
- We may update, modify, or discontinue specific features of the service as needed.
- These Terms may be updated periodically. Continued use of the service after updates constitutes acceptance of the updated terms.
- We will notify users of significant changes to these Terms when possible.
6. Personal Data and Privacy
- We may collect your email address for account registration, verification, and service communications.
- Personal data is processed for service provision, user identification, security, and notifications.
- We process data based on contract performance (service delivery) and legitimate interests (security, fraud prevention).
- You may request deletion of your personal data according to our privacy policy.
- Your privacy rights are protected under applicable data protection laws.
7. Prohibited Uses and Legal Compliance
7.1. Account Access Violations
Account Access Violations: Transfer of account or service access, use of virtual machines to bypass licensing restrictions, and multiple provision of your PC to third parties are strictly prohibited. Such violations are recorded, treated as a breach of this agreement, and result in fines.
- You may not share your account login credentials, API keys, or any other means of accessing the CarEdit service.
- You may not allow others to use the CarEdit service through your account.
- You may not transfer your account or service access to third parties.
- You may not use virtual machines, emulators, or other isolated computing environments to circumvent the licensing model of 1 user = 1 PC.
- You may not provide your PC to multiple third parties for factual use of the service on behalf of the license holder.
- The amount, procedure, and payment deadline of fines for violations are determined exclusively by the developer at its sole discretion.
7.2. Legal Compliance
- You must use the CarEdit service in compliance with all applicable laws, regulations, and third-party rights.
- You are prohibited from using the service for illegal, fraudulent, or harmful purposes.
- You must not use the service to infringe upon intellectual property rights, patents, copyrights, trademarks, or trade secrets of any third party.
- You are responsible for ensuring that your use of the service and distribution of results complies with applicable laws.
7.3. Manufacturer Warranties and Policies
- You understand that modifying vehicle ECUs or related systems may affect manufacturer warranties.
- You are responsible for understanding and complying with manufacturer warranties, policies, and terms before using the service.
- We provide the service as a tool, and you alone are responsible for how you use it and what you do with the results.
- We disclaim responsibility for any warranty voidance, warranty denial, or warranty-related issues resulting from your use of the service or the results you create.
- You assume all risks associated with warranty voidance and agree not to hold us liable for warranty-related consequences.
7.4. Server and Infrastructure Protection
- Interference with server-side components, infrastructure, APIs, or billing systems is prohibited.
- You must not attempt to reverse engineer, decompile, or interfere with the service's server-side functionality.
- Any attempt to compromise the security, integrity, or availability of our infrastructure is strictly prohibited.
8. Service Termination
- We reserve the right to suspend, terminate, or refuse service access to any user account at any time, for any reason, including but not limited to violation of these Terms, suspicious activity, abuse of the service, or at our sole discretion.
- We may suspend or terminate service without prior notice or explanation if we believe it is necessary to protect the integrity of the service, other users, or comply with legal obligations.
- While we strive to provide fair service, we reserve the right to make decisions regarding service access in our sole discretion.
- In cases of service termination due to Terms violation, no refund will be provided. In other cases, refunds will be handled according to our refund policy.
- You may cancel your subscription at any time through your account settings or by contacting support.
9. Your Rights to Results and Outputs
You Own What You Create:
- All results, outputs, files, data, and works created using the CarEdit service are yours.
- You have the full right to use, distribute, share, sell, publish, or otherwise dispose of any outputs you create.
- Your rights to your outputs are protected under applicable copyright and intellectual property laws.
- We encourage you to share and distribute the results of your work - that's what the service is designed for!
- You retain all ownership rights, copyright, and intellectual property rights in any outputs, results, files, or data created through your use of CarEdit.
- You may freely distribute, share, sell, license, or otherwise use your outputs for any lawful purpose.
- We claim no ownership or rights to any outputs, results, or data you create using the service.
- This section ensures your legal protection and rights regarding the outputs you create.
10. Limitation of Liability
- To the maximum extent permitted by applicable law, our total liability for any claims arising from or related to the CarEdit service shall not exceed the amount you paid for your subscription.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
- We disclaim responsibility for any consequences resulting from your use of the service or the results you create.
- You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the service or distribution of results, except to the extent prohibited by applicable law.
- Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
11. Governing Law and Dispute Resolution
- These Terms are governed by the laws determined by the service provider.
- We prefer to resolve disputes through our support channels before formal legal proceedings.
- Any disputes shall be resolved in accordance with applicable law.
- You retain all your legal rights and protections under applicable law.

Summary: By using CarEdit, you agree to keep your account access private and not share it with others.
